Your Three OWCP Appeal Options Under FECA

When your federal workers' compensation claim is denied, you have three formal appeal paths. Review each option below, then use the Appeal Strategy Selector to get a personalized recommendation.

Reconsideration

A written request asking OWCP to review your denied FECA claim again, based on new evidence. Must be submitted within one year of the decision date. The fastest and most straightforward appeal option for most claimants.

Timeline: OWCP has up to 180 days to issue a new decision.

Oral Hearing

A teleconference hearing before an OWCP hearing representative, where you present your case verbally and can submit additional evidence. Another choice is a review of the written record (shorter time frame to a decision). Request must be received within 30 days of the decision date.

Timeline: Decision typically issued 45–90 days for reviews of the record. Oral hearings take longer, 60-120 days (currently hearings is under backlog due to attrition).

ECAB Appeal

An appeal to the Employees' Compensation Appeals Board (ECAB), an independent body separate from OWCP. No new evidence may be submitted — ECAB reviews only whether OWCP correctly applied FECA law and procedures. Must be filed within 180 days of the decision date.

Timeline: Decisions can take 9–12 months depending on Board docket.
